General Terms and Conditions
1. Industry Provisions
These General Terms and Conditions (hereinafter referred to as the "Terms") govern the relationship between the operator of the website (hereinafter referred to as the "Seller") and the buyer (hereinafter referred to as the "Customer") in the field of bottled wine sales based on an individual agreement concluded via electronic communication.
The Seller does not operate an online store – the offer is not presented in the form of an e-shop but solely as an informative overview of the assortment (e.g., in the form of text files) on the website. Orders are placed individually, outside of an automated ordering system.
2. Assortment and Availability
The wines listed on the website are offered in limited quantities and availability may vary. In the event of unavailability, the Customer will be informed via email, and no compensation or liability on the part of the Seller shall be required.
For wines classified as Fine Wine, the Seller acts as a reseller – not as a direct supplier or producer. The Seller bears no responsibility for defects such as cork taint, cork condition, label condition, wine level, or similar.
3. Order and Contract Conclusion
An order becomes binding once mutually confirmed via email or other electronic means. The Seller reserves the right to reject an order without providing a reason.
The Customer confirms that they are over 18 years of age. Alcohol is sold only to persons over the age of 18 in accordance with Act No. 65/2017 Coll., on the Protection of Health from the Harmful Effects of Addictive Substances.
4. Price and Payment
Prices are listed in Czech crowns (CZK) or euros (EUR) and are valid at the time the order is confirmed.
We are not VAT payers / We are VAT payers (to be specified based on your situation).
Payment is only possible via bank transfer based on an issued invoice. The invoice will be sent electronically after the order is confirmed. The Seller reserves the right to request advance payment.
5. Delivery and Shipping Terms
Shipping is arranged individually based on an agreement with the Customer and is calculated according to the distance between the shipping and delivery locations. Delivery costs are not included in the wine price unless stated otherwise.
The Seller is not responsible for delays or damages caused by the carrier. The Customer is required to inspect the shipment for damage upon delivery.
6. Complaints and Returns
The Seller does not provide a guarantee for the taste or quality of the wine, especially in the case of archival and collectible wines. Due to the nature of the goods and the fact that the Seller is not the direct producer, complaints cannot be made regarding defects typical for mature or older wines (e.g., cork taint, oxidation, low fill levels).
Complaints regarding visible damage during transport must be made immediately upon receipt – ideally with photographic documentation. Each complaint will be assessed individually by the Seller.
7. Withdrawal from the Contract
The Customer has the right to withdraw from the contract within 14 days of receiving the goods, in accordance with Act No. 89/2012 Coll., the Civil Code. Wines must be returned in their original condition, unopened, and properly packaged.
Returns are only possible with prior approval from the Seller. Return shipping costs are borne by the Customer.
8. Personal Data Protection
The Customer agrees to the processing of their personal data for the purposes of order fulfillment, communication, and the execution of rights and obligations arising from the contract. Personal data is not shared with third parties, except where necessary for delivery purposes. Data processing is governed by Act No. 110/2019 Coll., on the Processing of Personal Data, and the GDPR regulation.
9. Final Provisions
These Terms and Conditions are governed by the laws of the Czech Republic. Any disputes shall be resolved by the competent courts at the Seller’s registered office, unless otherwise stipulated by law.
The Seller reserves the right to change these Terms at any time. The current version is always available upon request or within the scope of electronic communication when confirming the order.
